1. About these terms
These Terms and Conditions govern your access to and use of the website at maximasa.co.za and any subdomain or page forming part of it (the "website"). By using the website you agree to these terms. If you do not agree to them, please do not use the website.
We may amend these terms from time to time. The version published on the website at the time you use it is the version that applies.

This information is published in accordance with section 43 of the Electronic Communications and Transactions Act 25 of 2002.
Maxima SA is a South African security hardware brand established in 2015. We import and brand our own range, which is available through our dealer network and directly from us by requesting a quotation.
3. Direct and dealer supply
Maxima SA supplies stockists, distributors, installers and customers purchasing directly. We work closely with our partners to protect the dealer network through recommended retail pricing, fair competition and consistent service standards.
Any customer may request a quotation. Dealer and trade account applications are reserved for businesses acquiring goods for resale or for installation on behalf of their own customers.
Customers may buy Maxima SA products through one of our stockists, listed on our Stockists page, or request a quotation directly from us. We do not warrant the pricing, stock levels, terms or conduct of any independent stockist. When you buy from a stockist, your contract is with the stockist, not with us.
4. The website is a catalogue, not an online shop
The website is a product catalogue and quotation tool.
- We do not display prices on the website and we do not accept payment through the website.
- Adding a product to the quote basket and submitting a quote request does not create a sale, a reservation of stock or any binding agreement.
- A quote request is an invitation for us to quote. Any quotation we issue is an offer, which you may accept or decline.
- A sale is concluded only when we accept your order in writing.
Because no transaction is concluded on the website, the seven day cooling off right in section 44 of the Electronic Communications and Transactions Act does not apply to a quote request submitted through the website.
5. Quotations and pricing
Unless the quotation itself states otherwise:
- A quotation is valid for the period stated on it. If no period is stated, the quotation is an estimate only and is not binding, as prices are subject to change without notice.
- Prices quoted are exclusive of VAT, delivery and any other charges, unless expressly stated.
- Dealer pricing is confidential, is issued to the named dealer only and may not be disclosed to any third party or published, including on any website, marketplace or price comparison platform, without our prior written consent.
- Prices are subject to change without notice, including as a result of exchange rate movement, supplier price increases or changes in duties and levies.
- A quotation is subject to stock availability at the time your order is accepted.
- Minimum order quantities and account terms may apply. These will be set out in your trade account agreement.
6. Product information, images and specifications
We take reasonable care to describe our products accurately. However:
- Product descriptions, specifications, dimensions, holding forces, capacities and performance figures are indicative rather than guaranteed.
- Product images are for illustration. Colour, finish, packaging, bracketry and included accessories may differ from the image shown.
- Manufacturing revisions may change specifications or model codes without notice.
- Errors and omissions are excepted. We reserve the right to correct any error on the website, in a quotation or in an order confirmation.
If a specific specification is critical to an installation, please confirm it with us in writing before you order. You remain responsible for satisfying yourself that a product is suitable for the intended application. If you resell or install the product, you are also responsible for advising your own customer correctly.
7. Installation, compliance and resale obligations
Maxima SA products are intended for installation by trained installers. Where a product is mains connected, forms part of an access control or locking system, or is subject to a South African standard or regulation, it is the responsibility of the installer and the property owner to ensure that the installation complies and that any required certificate of compliance is obtained.
If you resell Maxima SA products you agree to:
- pass on the product documentation and any safety instructions supplied with the product;
- not alter, remove or obscure Maxima SA branding, serial numbers or labelling;
- not misrepresent the specification, origin, approval status or warranty of any product;
- comply with all applicable laws in the territory in which you resell.
Nothing on the website constitutes installation, design or engineering advice.
8. Warranty
Maxima SA products carry the warranty stated on the product documentation or in the applicable trade terms. In summary: The customer agrees that any equipment sold to them carries a warranty against defective components and manufacturing for a period of 12 months after delivery, and that such warranty is valid only if the customer has properly, in accordance with the manufacturer specification, installed, operated, maintained and serviced the equipment. We reserve the right to refuse any warranty claim for damage caused by any factor beyond the specifications or performance levels of the product. We reserve the right to charge a fee of 10 percent of the value of goods received for repair that are found to be free of fault or defect. No warranty claim, exchange, credit or refund will be processed without the original invoice being presented. Where the customer requires us to collect any goods, the customer is liable for the reasonable costs of that collection.
Warranty claims must be submitted to us with proof of purchase and, where requested, the product itself for assessment. Warranty does not cover fair wear and tear, incorrect installation, incorrect application, unauthorised modification, misuse, neglect, water or lightning damage, power surge damage, or damage caused by accident or by an act of nature. Labour, site attendance, shipping and consequential costs are not covered.
Full warranty and returns terms are set out in our trade terms. Where the Consumer Protection Act 68 of 2008 applies to a transaction, nothing in this clause limits the rights it confers.
9. Brand, intellectual property and use of our marks
The Maxima SA name, logo, product names, model codes, packaging, product photography and website content are our property or are licensed to us, and are protected by South African and international intellectual property law.
Appointed stockists may use the Maxima SA name and logo solely to promote the resale of genuine Maxima SA products, in unaltered form and in accordance with any brand guidelines we issue. That permission is revocable at any time and ends when the stockist relationship ends. No other use is permitted.
You may not register or use any domain name, trading name, social media handle or trade mark that incorporates or is confusingly similar to "Maxima SA".
You may view the website and print or download extracts for your own internal business use. You may not otherwise copy, reproduce, republish, distribute, adapt, frame, scrape, mine or commercially exploit any part of the website without our prior written permission.
Third party manufacturer and brand names that appear on the website are the property of their respective owners and are used for identification purposes only.
10. Acceptable use
You agree not to:
- use the website for any unlawful purpose or in a way that breaches any applicable law;
- introduce any virus, trojan, worm, logic bomb or other harmful code;
- attempt to gain unauthorised access to the website, the server on which it is hosted or any connected system;
- use any automated system to scrape, harvest or copy content, product data or contact details from the website;
- submit false, misleading or fraudulent information through any form on the website, including misrepresenting your eligibility for a dealer or trade account;
- use contact details obtained from the website to send unsolicited commercial communications.
Unauthorised access to or interference with the website may constitute an offence under Chapter 13 of the Electronic Communications and Transactions Act 25 of 2002 and the Cybercrimes Act 19 of 2020.
11. Availability of the website
We do not warrant that the website will be available uninterrupted or free of error, that defects will be corrected, or that the website or the server that makes it available are free of viruses or other harmful components. We may suspend, withdraw or restrict all or part of the website without notice.
12. Links to other websites
The website may contain links to third party websites, including those of our stockists. Those links are provided for convenience only. We do not control and are not responsible for the content, products, services, pricing or privacy practices of any linked site.
13. Limitation of liability
To the maximum extent permitted by law:
- the website and its content are provided "as is" and "as available", without warranty of any kind, whether express or implied;
- we are not liable for any indirect, incidental, special, punitive or consequential loss, including loss of profit, loss of business, loss of data or loss of goodwill, arising from your use of or inability to use the website or from reliance on any information on it;
- our liability for goods supplied is limited to the replacement or repair of the goods, at our discretion, in respect of goods returned under warranty from the date of delivery; and our total liability arising from your use of the website is limited to the amount you have paid us in respect of the relevant transaction.
Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability under sections 60 and 61 of the Consumer Protection Act 68 of 2008 where that Act applies.
14. Indemnity
You indemnify us and hold us harmless against any claim, loss, damage, cost or expense, including reasonable legal costs, arising from your breach of these terms, your unlawful or negligent use of the website, or any misrepresentation you make to your own customer about a Maxima SA product.
15. Privacy and personal information
Our collection and use of personal information is governed by our Privacy Policy and our Cookie Policy, which form part of these terms. Our PAIA Manual is also available.
16. Electronic communications
You consent to receiving communications from us electronically. Any communication we send to the email address you provide is deemed to have been received on the day it was sent, unless the sender is notified that it was not delivered.
17. Governing law and jurisdiction
These terms are governed by the law of the Republic of South Africa. You consent to the jurisdiction of the Magistrate's Court having jurisdiction in respect of any dispute arising from these terms or your use of the website, without prejudice to our right to institute proceedings in any other competent court.
18. Complaints
If you have a complaint, please contact us first at info@maximasa.co.za or 011 422 6001 so that we can try to resolve it directly. Where the Consumer Protection Act applies, you may refer an unresolved complaint to the Consumer Goods and Services Ombud at www.cgso.org.za, or to the National Consumer Commission.
19. General
- Severability. If any provision of these terms is found to be invalid or unenforceable, that provision is severed and the remaining provisions continue in full force.
- No waiver. Our failure to enforce any provision does not amount to a waiver of that provision or of our right to enforce it later.
- Whole agreement. These terms, together with the Privacy Policy, Cookie Policy, any trade account agreement and any written quotation or order confirmation, constitute the whole agreement between us in relation to your use of the website. Where a signed trade account agreement conflicts with these terms, the trade account agreement prevails.
- Headings. Headings are for convenience only and do not affect interpretation.
